Terms of service
These terms govern your use of AI Tokens: the website aitokens.ch, the dashboard (my.aitokens.ch), the chat (chat.aitokens.ch), the documentation (wiki.aitokens.ch) and the API (api.aitokens.ch). AI Tokens is operated and sold by Daiko Lab SA, Via San Gottardo 86, 6900 Massagno, Switzerland ("we"). Daiko Lab SA is your contractual counterparty and issues the invoices. By creating an account you accept these terms.
1. The service
AI Tokens gives access to open-weight AI models through an API compatible with OpenAI's, and through the chat. You pay for what you use, from prepaid credit.
The models, their prices and the countries where each one runs are listed on aitokens.ch and in the documentation. The catalogue is new and still changing. A model can be slow or unavailable for a while, for example during maintenance or after a fault.
With the model auto, the service chooses the model for each request, as the documentation describes; you pay the rates of the model that answers. In the dashboard you can give each API key a monthly spending limit: a request whose highest possible cost does not fit in what is left of it is refused before any model runs.
2. Your account
- You must be at least 16 years old.
- You sign up with your name, an e-mail address of yours and a password. We send a link to confirm the address. The dashboard and the chat open after you confirm it.
- One account per person or company. Do not create several accounts to collect the free credit.
- You are responsible for everything done with your account and your API keys (they start with
sk-at-). Keep keys as you would a password, and do not put them in code you share. If a key leaks, revoke it at once on the API keys page and tell us at info@daikolab.ch.
3. Credit, prices and payment
- Prepaid credit in Swiss francs. Requests are paid from your credit balance.
- Prices are per model, in CHF per million tokens, with separate prices for input and output tokens. Audio, pictures and video have a price per unit. The price that applies is the one published on aitokens.ch or in the documentation when you make the request.
- VAT. Prices are in Swiss francs, excluding VAT. Swiss VAT at 8.1% is added on the invoice from the day Daiko Lab SA is registered for VAT.
- Reasoning. The tokens a model spends reasoning before it answers count as output tokens.
- How we count. Each request is charged from the token counts the model reports. An answer you stop, or that breaks after its text has started, is charged for the tokens it used; when the model did not report them, we estimate about four characters per token. The pricing page of the documentation lists what is charged and what is not. Each request's cost is in your usage records in the dashboard.
- Balance. A request starts only while your balance is above zero. The last request can take it slightly below zero; the difference is taken from your next top-up.
- Free credit. When you confirm your e-mail address, we load CHF 2 of free credit, once per account. No card is needed. Free credit has no cash value and is not refunded or transferred.
- Top-ups. You top up by card on the Billing page of the dashboard, from CHF 10 to CHF 5,000. Stripe processes the payment, and the credit is loaded as soon as Stripe confirms it. Stripe sends a receipt by e-mail; for an invoice from Daiko Lab SA, write to info@daikolab.ch.
- Bonus credit. A top-up of CHF 50 or more comes with more credit: 2% from CHF 50, 4% from CHF 100, 7% from CHF 500, 10% from CHF 1,000, 20% from CHF 5,000. An automatic top-up adds 5% more, on top of the step of its amount: an automatic top-up of CHF 1,000, for example, loads CHF 1,150. Bonus credit is used like paid credit; like free credit, it has no cash value and is not refunded.
- Automatic top-up. If you switch it on in the dashboard, you authorise Daiko Lab SA to charge your card, saved at Stripe, the amount you choose each time your credit falls below the threshold you choose. You can change it or switch it off at any time on the Billing page. If a charge fails, it switches off and we tell you by e-mail.
- Paid credit does not expire. It is not refunded, except where we fail to provide the service or as described in section 9. When an account is deleted, its balance is deleted with it.
4. Where requests are processed
Every model runs in Switzerland. Once a request reaches us, it does not leave Switzerland. The privacy notice explains where your data are processed.
5. Acceptable use
Do not use AI Tokens to:
- produce or spread content that is illegal under Swiss law or the law of your country, such as material that sexualises minors, incitement to hatred, fraud or copyright infringement;
- produce disinformation, defamation, or deepfakes of real people without their consent;
- attack or overload the service, get around its limits or its content checks, or try to extract model weights;
- share or resell access to your account or keys without our written agreement;
- process other people's personal data without a legal basis.
Requests for pictures, videos and speech may be checked automatically by one of our own models before anything is generated, and pictures and videos again before they are delivered. A request that fails the check is refused.
If you send us personal data of other people, you must have the right to do so. For those data you are the controller, and we process them on your behalf, only to provide the service.
6. Your content and the answers
Your prompts, files and conversations remain yours. We do not use them to train models. The answers the models generate are yours, as far as the law allows.
Models make mistakes, also when they sound sure. Check answers before you rely on them, especially numbers, dates, quotations and code. For medical, legal or financial matters, a professional's judgement is still needed.
Each open-weight model is published by its developer under its own licence. You must respect it when you use the model and its answers.
7. Liability
We provide the service as it is. We do not promise that it will run without interruptions or errors, or that answers will be correct or fit for a particular purpose.
As far as Swiss law allows, our total liability is limited to the amount you paid us in the 12 months before the event that caused the damage. We are not liable for indirect damage, lost profit or lost data. These limits do not apply to damage caused intentionally or through gross negligence. If you are a consumer, mandatory consumer protection rules of your country remain unaffected.
8. Suspension and closing
We may suspend the service, or an account, for security reasons, for maintenance, or when these terms are broken. If we suspend or close your account for a breach, we tell you why by e-mail.
You can delete your account at any time, with your password, on the Account page of the dashboard. It is switched off at once, and you have 30 days to change your mind. The privacy notice says what is deleted and when.
9. Changes
We may change these terms, the prices and the catalogue of models. We e-mail you at least 30 days before a price increase, the removal of a model, or a change to these terms that limits your rights. If you do not accept the change, you can close your account before it applies, and we refund the paid credit you have not used (not the free or bonus credit).
Changes that do not affect your rights, such as corrections and clarifications, apply when we publish them. The date at the top says when this version took effect.
10. Law and courts
These terms are governed by Swiss law, without its conflict-of-laws rules and without the Vienna Convention on the International Sale of Goods. The courts of Lugano, Switzerland, have jurisdiction. If you are a consumer, you can also go to the courts that the mandatory law of your place of residence allows.
